Inner Athlete

Parent/Guardian Agreement, Assumption of Risk and Release

Version 2026-10-04-v1 · Ontario, Canada

Please read this carefully. It affects your legal rights.

What a parent can and cannot sign away in Ontario Ontario law does not allow a parent to waive their child's own right to bring a claim, and nothing in this document attempts to. Section 6 releases your claims, not your child's. Your child's own rights are unaffected. We would rather tell you that plainly than have you discover it later.

1. What Inner Athlete is

Inner Athlete provides pre-written strength and conditioning programmes delivered online, with instructional video. It is a self-directed programme.

No one from Inner Athlete is present, watching, or supervising your child while they train. We cannot see their technique, correct their form in the moment, or respond to anything that happens during a session. You, the parent or guardian, are responsible for supervising your child's participation.

2. This is not medical advice

Inner Athlete does not provide medical, physiotherapy, dietary or rehabilitation advice, and nothing in the programme is a substitute for care from a qualified health professional.

3. Medical clearance (required)

You confirm that:

You agree to stop the programme and seek medical advice if your child experiences pain, dizziness, breathlessness, chest discomfort, or any symptom that concerns you.

4. Assumption of risk

Physical training carries real risk of injury. This includes but is not limited to muscle strains and tears, joint and ligament injury, fractures, concussion from falls, heat illness, fainting, aggravation of a pre-existing condition, and in rare cases catastrophic injury or death.

These risks exist even when a programme is well designed and properly followed. They are increased by training unsupervised, by using equipment improperly, by training in an unsuitable space, and by continuing when fatigued or unwell.

You acknowledge these risks and accept them on your child's behalf and your own.

5. Your responsibilities

You agree that you will:

6. Release

In exchange for being allowed to take part, you — on your own behalf — release and agree not to sue Inner Athlete, Daryl Devonish, and their respective officers, employees, contractors and agents ("the Released Parties") from any and all claims, demands, actions and costs arising out of your child's participation in the programme, including claims arising from the ORDINARY NEGLIGENCE of the Released Parties.

This release does not apply to gross negligence, reckless conduct, or wilful misconduct, and does not limit any right you have that cannot be waived under the Consumer Protection Act, 2002.

You understand that you are giving up your own legal rights by agreeing to this, and that you are doing so freely.

7. Indemnity

You agree to indemnify the Released Parties against any claim brought by or on behalf of your child arising from participation, to the extent permitted by law.

8. Refunds and cancellation

Programme access is sold in blocks. Memberships renew automatically and can be cancelled at any time from your account; cancellation takes effect at the end of the current billing period. Our refund policy is set out separately and forms part of this agreement.

9. Privacy

What we collect about you and your child, and why, is set out in our privacy policy. Consent to use your child's image in marketing is separate and optional, and you can withdraw it at any time.

10. Governing law

This agreement is governed by the laws of the Province of Ontario and the laws of Canada applicable in it.

What you are agreeing to at sign-up

Each of these is ticked separately on the join form. The first three are required; the fourth is optional and changes nothing about the programme.

Health screening

Based on the PAR-Q+ (Physical Activity Readiness Questionnaire), the Canadian standard. If any answer is yes, obtain physician clearance before your child starts.

  1. Has a doctor ever said your child has a heart condition, or that they should only do physical activity recommended by a doctor?
  2. Does your child feel pain in the chest when doing physical activity?
  3. In the past month, has your child had chest pain when not doing physical activity?
  4. Does your child lose balance because of dizziness, or ever lose consciousness?
  5. Does your child have a bone or joint problem that could be made worse by a change in physical activity?
  6. Is your child currently taking prescribed medication for a chronic condition?
  7. Has your child had a concussion in the last 12 months?
  8. Is there any other reason your child should not do physical activity?
Concussion Question 7 is not part of the standard PAR-Q+. It is here because this is a youth sport population, and return to activity after concussion is governed in Ontario by Rowan's Law (Concussion Safety), 2018. If your child is in a return-to-play protocol, that protocol takes precedence over this programme.
